US extends work permit validity for foreign workers

The United State Citizenship and Immigration Services(USCIS) has announced a significant extension to work permit validity periods to ease delays and ensure continued employment authorization for foreign student including Nigerians.

A temporary final rule (TFR) issued under the new policy has increase the 180-day automatic extension duration for some Employment Authorization Documents (EADs) to a maximum of 540 days. This pertains to qualified candidates filing between now and September 30, 2025, as well as those who have timely filed EAD renewal applications on or after October 27, 2023.

This policy could possibly impact an estimate of 800,000 individuals and their respective employees, will promote workforce continuity by providing more certainty for employers and foreign workers including asylum seekers and Temporary Protected Status holders. TFR complement USCIS’s Ongoing effort to streamline the work authorization process.

In order to minimize disruptions in employment authorization for non-citizens waiting for the processing of their EAD renewal applications, USCIS Director Ur M. Jaddou stressed the significance of this program. The 540-day validity period extension promotes workforce continuity by providing more certainty for employers and foreign employees alike.
