A Federal High Court sitting in Kano has set aside the actions of the Kano State government in repealing the Kano Emirate Council Repeal Law 2024.
A new law passed by the Kano State House of Assembly on May 23 and quickly signed by Governor Abba Yusuf was used to dethrone Emir Aminu Ado Bayero and reinstate Muhammadu Sanusi II as the 16th Emir of Kano.
This law also reversed the creation of four new emirates—Bichi, Rano, Karaye, and Gaya—set up by former governor Abdullahi Ganduje in 2020.
Sarkin Dawaki Babba, Aminu Danagundi, represented by Chikaosolu Ojukwu (SAN), has contested the legality of this law in court, seeking to have it invalidated.
The presiding judge, Justice Abdullahi Liman, had adjourned the ruling till this Thursday from last Friday.
Eyitayo Fatogun (SAN), representing the State House of Assembly and its Speaker, told the court about a notice of appeal filed at the Court of Appeal to delay the proceedings.
However, Justice Liman noted there was no proof that the appeal had been processed or any formal request for a delay submitted.
On Thursday, Justice Liman nullified the Kano government’s actions and ordered all parties to maintain the current situation.
He stated that the defendants knew about the court’s temporary order but ignored it and proceeded with the law’s implementation.
Therefore, Justice Liman decided to use his authority to enforce compliance with his order.
