Justice James Omotosho of the Federal High Court in Abuja, on Monday, dismissed the fundamental human rights suit filed by Nnamdi Kanu, the detained leader of the Indigenous People of Biafra (IPOB), against the Federal Government.
Kanu filed a lawsuit against the Attorney-General of the Federation and the Department of State Services seeking N1 billion in damages for alleged rights violations.
In the suit numbered FHC/CS/1633/2023, the IPOB leader asserted that the DSS and its Director-General infringed on his right to a fair hearing by allegedly obstructing his lawyers from freely communicating with him while he was detained, thereby impeding his defense preparation in his criminal trial.
Justice Omotosho, in delivering his judgment on the case, concluded that Kanu did not provide sufficient credible evidence to support his claims.
The judge found no substantiation that Kanu’s interactions with his legal representatives were disrupted, that he was denied unimpeded access to his lawyers, or that DSS personnel illegally monitored his discussions with his legal team, which would have constituted a violation of his right to a fair hearing.
